Introduction\u003C/h2>\n    \u003Cp>1.1 These Terms and Conditions (hereinafter \u003Cstrong>\"Terms\"\u003C/strong>) govern the mutual rights and obligations between:\u003C/p>\n    \u003Cp>\u003Cstrong>The Provider:\u003C/strong>\u003C/p>\n    \u003Cul>\n        \u003Cli>\u003Cstrong>Stelix holding s.r.o.\u003C/strong>\u003C/li>\n        \u003Cli>Company ID (IČO): 01443909\u003C/li>\n        \u003Cli>VAT ID (DIČ): CZ01443909\u003C/li>\n        \u003Cli>Registered seat: Ke stadionu 1953, 272 01 Kladno, Czech Republic\u003C/li>\n        \u003Cli>Registered in the Czech Commercial Register\u003C/li>\n        \u003Cli>Contact e-mail: \u003Ca href=\"mailto:info@stelixholding.cz\">info@stelixholding.cz\u003C/a>\u003C/li>\n    \u003C/ul>\n    \u003Cp>(hereinafter the \u003Cstrong>\"Provider\"\u003C/strong>) and the \u003Cstrong>User\u003C/strong>, meaning any natural or legal person using the fitliftly service (hereinafter the \u003Cstrong>\"User\"\u003C/strong>).\u003C/p>\n    \u003Cp>1.2 These Terms govern the conditions for providing the fitliftly service, available at the domain \u003Cstrong>fitliftly.com\u003C/strong> and through mobile applications for iOS and Android (hereinafter the \u003Cstrong>\"App\"\u003C/strong> or the \u003Cstrong>\"Service\"\u003C/strong>).\u003C/p>\n    \u003Cp>1.3 These Terms form an integral part of the contract concluded between the Provider and the User at the moment of completed registration.\u003C/p>\n    \u003Cp>1.4 Matters not regulated by these Terms are governed in particular by Act No. 89/2012 Coll., the Civil Code, and where the User is a consumer, also by Act No. 634/1992 Coll., on Consumer Protection.\u003C/p>\n\n    \u003Ch2>2. Definitions\u003C/h2>\n    \u003Cul>\n        \u003Cli>\u003Cstrong>App / Service\u003C/strong> — the fitliftly web and mobile application allowing workout logging, workout booking at venues, social interaction, trainer client management and multi-venue management for partners.\u003C/li>\n        \u003Cli>\u003Cstrong>User Account\u003C/strong> — an account created by registration, used for authentication and access to the Service.\u003C/li>\n        \u003Cli>\u003Cstrong>Role\u003C/strong> — the account type defining the available functionality scope (user, trainer, venue, partner etc.).\u003C/li>\n        \u003Cli>\u003Cstrong>Venue\u003C/strong> — a physical location (fitness centre, gym, hall) managed via the App by a Partner.\u003C/li>\n        \u003Cli>\u003Cstrong>Partner\u003C/strong> — the operator of one or more Venues using the App for business management.\u003C/li>\n        \u003Cli>\u003Cstrong>Trainer\u003C/strong> — a natural person providing training services using the App to manage clients, create workouts and templates.\u003C/li>\n        \u003Cli>\u003Cstrong>Workout\u003C/strong> — an event (classic, circuit or private) created by a Trainer or Venue that Users may book.\u003C/li>\n        \u003Cli>\u003Cstrong>Credit\u003C/strong> — a digital value unit tied to a specific Partner, used to pay for venue entry and/or workout booking.\u003C/li>\n        \u003Cli>\u003Cstrong>Credit Wallet\u003C/strong> — the record of the User's current Credit balance with a given Partner.\u003C/li>\n        \u003Cli>\u003Cstrong>QR check-in\u003C/strong> — the process of recording entry/exit to/from a Venue via QR code scanning.\u003C/li>\n        \u003Cli>\u003Cstrong>Sport Pass\u003C/strong> — an external card (MultiSport, Membros, Benefit Plus etc.) that the User may register in the App for reference only.\u003C/li>\n        \u003Cli>\u003Cstrong>Content\u003C/strong> — texts, photos, videos, messages and other materials submitted to the App.\u003C/li>\n    \u003C/ul>\n\n    \u003Ch2>3. Registration and User Account\u003C/h2>\n    \u003Cp>3.1 Use of the Service requires registration of a User Account — by filling in the registration form and verifying the e-mail address, or via social sign-in (Google, Apple, Facebook) which authenticates identity through the identity provider.\u003C/p>\n    \u003Cp>3.2 The User shall provide true, complete and up-to-date information. The User is liable for any damage caused by false information.\u003C/p>\n    \u003Cp>3.3 The Account is bound to one specific person and may not be shared, sold or transferred to any third party. Detected breaches may result in immediate account blocking.\u003C/p>\n    \u003Cp>3.4 Users under 15 may not use the App independently. Users aged 15–18 are recommended to obtain the consent of their legal guardian. For minors the Provider undertakes to comply with the applicable provisions of the GDPR (Art. 8).\u003C/p>\n    \u003Cp>3.5 The User shall keep the account password confidential. The Provider is not liable for any damage caused by disclosure of the password to a third party.\u003C/p>\n    \u003Cp>3.6 The User may terminate use of the Service at any time by deleting the Account in the \"Privacy & Data\" section. Account deletion does not extinguish the Provider's right to retain data required by law (in particular accounting records).\u003C/p>\n\n    \u003Ch2>4. Description and Scope of the Service\u003C/h2>\n    \u003Cp>4.1 The Service provides in particular:\u003C/p>\n    \u003Cul>\n        \u003Cli>\u003Cstrong>Social network\u003C/strong> — activity feed, friends, following trainers and venues, chat (direct messages, group conversations, venue chat).\u003C/li>\n        \u003Cli>\u003Cstrong>Training and logging\u003C/strong> — workout creation and logging, statistics, personal records (PR), charts, activity heatmap.\u003C/li>\n        \u003Cli>\u003Cstrong>Workout booking\u003C/strong> — registration for workouts created by Trainers/Venues, watchdog (waitlist notification).\u003C/li>\n        \u003Cli>\u003Cstrong>Credit system\u003C/strong> — purchasing Credits from individual Partners and using them for entries and workouts.\u003C/li>\n        \u003Cli>\u003Cstrong>QR check-in/check-out\u003C/strong> — recording physical presence at a Venue.\u003C/li>\n        \u003Cli>\u003Cstrong>Gamification\u003C/strong> — badges, challenges, leaderboards, XP, streaks.\u003C/li>\n        \u003Cli>\u003Cstrong>Sport Passes\u003C/strong> — register external sport cards for personal reference.\u003C/li>\n        \u003Cli>\u003Cstrong>Health Sync\u003C/strong> — optional synchronisation of health data from Apple HealthKit / Google Health Connect (see Art. 6 and the Privacy Policy).\u003C/li>\n        \u003Cli>\u003Cstrong>Partner / Trainer / Venue functions\u003C/strong> — workout creation, client management, multi-venue management, billing, invoicing.\u003C/li>\n    \u003C/ul>\n    \u003Cp>4.2 The specific scope of features available to the User depends on the assigned Role. The Provider reserves the right to modify, add or restrict App features for further development of the Service.\u003C/p>\n    \u003Cp>4.3 Some features may require additional conditions to be met (e.g. active venue membership, positive Credit balance, Partner approval).\u003C/p>\n\n    \u003Ch2>5. Rights and Obligations of the User\u003C/h2>\n    \u003Cp>5.1 The User undertakes to:\u003C/p>\n    \u003Cul>\n        \u003Cli>not use the App for any purposes other than those permitted;\u003C/li>\n        \u003Cli>not upload Content that infringes the rights of third parties, breaches legal regulations or good morals (in particular defamatory, discriminatory, sexually explicit, violent, drug-related content or content infringing copyright);\u003C/li>\n        \u003Cli>not attempt to bypass security, decompile the source code, automatically extract data (scraping), overload infrastructure with excessive requests or otherwise disrupt the operation of the Service;\u003C/li>\n        \u003Cli>not impersonate another person or misuse other Users' personal data;\u003C/li>\n        \u003Cli>not spam other Users with messages, invitations or commercial offers without the Provider's consent.\u003C/li>\n    \u003C/ul>\n    \u003Cp>5.2 The User grants the Provider a non-exclusive, royalty-free and worldwide licence to use the Content uploaded to the App, \u003Cstrong>only to the extent and for the duration necessary to provide the Service\u003C/strong> (display to other Users according to privacy settings, backup, technical processing), with the right to sublicense to infrastructure providers. \u003Cstrong>The licence to the relevant Content expires upon deletion of that Content or termination of the account\u003C/strong>; the Provider may retain it only in backups for a necessary period and is not obliged to remove copies made by other Users in accordance with privacy settings or copies that must be retained by law.\u003C/p>\n    \u003Cp>5.3 The Provider is entitled to remove Content infringing these Terms or applicable law without prior notice and, in serious cases, to block the account.\u003C/p>\n    \u003Cp>5.4 The User shall behave at Venues in accordance with their house rules. The App only mediates the booking; the actual service is provided by the Venue operator.\u003C/p>\n\n    \u003Ch2>6. Health Sync (Health Data)\u003C/h2>\n    \u003Cp>6.1 The Health Sync feature is \u003Cstrong>optional\u003C/strong> and requires the User's \u003Cstrong>explicit consent\u003C/strong> granted in the App.\u003C/p>\n    \u003Cp>6.2 Synchronisation is performed from \u003Cstrong>Apple HealthKit\u003C/strong> (iOS) or \u003Cstrong>Google Health Connect\u003C/strong> (Android). The scope of data is limited to what the User has authorised at the system level.\u003C/p>\n    \u003Cp>6.3 The User may withdraw consent at any time in the App settings or at the operating system level. After withdrawal, the App will no longer synchronise health data and existing records may be deleted on request.\u003C/p>\n    \u003Cp>6.4 Further conditions for processing health data are set out in the Privacy Policy.\u003C/p>\n\n    \u003Ch2>7. Credit System\u003C/h2>\n    \u003Cp>7.1 Credits in the App are \u003Cstrong>tied to a specific Partner or Trainer\u003C/strong> (closed-wallet principle). A Credit purchased from Partner A cannot be used at Partner B or with a Trainer, and vice versa. The App does not provide any universal or transferable wallet.\u003C/p>\n    \u003Cp>7.2 Credits cannot:\u003C/p>\n    \u003Cul>\n        \u003Cli>be exchanged back into money (except for statutory refund cases under Art. 11);\u003C/li>\n        \u003Cli>be transferred between Users;\u003C/li>\n        \u003Cli>be transferred between Partners or Trainers.\u003C/li>\n    \u003C/ul>\n    \u003Cp>7.3 \u003Cstrong>Credit usage\u003C/strong>: Credits are deducted upon (a) workout booking at a Partner's Venue, (b) entry to a Venue via QR check-in, (c) other services per the Partner's price list. Credits tied to a Trainer may be used solely for that Trainer's workouts.\u003C/p>\n    \u003Cp>7.4 \u003Cstrong>Negative balance\u003C/strong>: A Partner may allow a negative balance up to a defined limit. A negative balance constitutes debt that the User must settle upon the next top-up. Late-cancellation penalties are always deducted, even where no negative balance is permitted.\u003C/p>\n    \u003Cp>7.5 \u003Cstrong>First-time exemption\u003C/strong>: A Partner may provide the first workout or entry free of charge. This is a marketing decision of the Partner; the User has no enforceable right to it.\u003C/p>\n    \u003Cp>7.6 \u003Cstrong>Credit validity\u003C/strong>: Credits do not have implicit expiry unless the Partner specifies otherwise; in such case the expiry period is communicated at purchase. Upon account termination Credits expire without entitlement to refund (except for statutory refund cases).\u003C/p>\n    \u003Cp>7.7 \u003Cstrong>Trainer Credits\u003C/strong>: A Trainer with an approved payment profile in the App may accept Credits tied to their person. The provisions of this Article apply to such Credits accordingly; they are used for the given Trainer's workouts and the contractual relationship regarding the workout is concluded between the User and the Trainer.\u003C/p>\n    \u003Cp>7.8 \u003Cstrong>Refunds\u003C/strong>: Refunds for cancelled workouts or timely deregistrations are made \u003Cstrong>in Credits\u003C/strong> — by crediting them back to the Credit wallet with the same Partner or Trainer they were spent from. This does not create an entitlement to a monetary refund; any return of funds (in particular for statutory reasons) is handled by the User directly with the Partner or Trainer as the payment recipient. The Provider does not hold Users' funds.\u003C/p>\n    \u003Cp>7.9 \u003Cstrong>Partner or Trainer Ceasing Operations\u003C/strong>: Credits constitute the User's claim against the specific Partner or Trainer as the payment recipient, not against the Provider (Art. 7.8). If a Partner or Trainer terminates or suspends their activity or stops offering services in the App, unspent Credits held with them may no longer be usable; their settlement (spending down or a refund) is handled by the User directly with the Partner or Trainer concerned. In such a case the Provider will give the User reasonable assistance (in particular by disclosing the payment recipient's identification and contact details to the extent necessary to assert the claim), but is not liable for the Partner's or Trainer's obligations. Cancellation of a Partner's or Trainer's account in the App is conditional on settling their clients' unspent Credits.\u003C/p>\n\n    \u003Ch2>8. Workout Booking\u003C/h2>\n    \u003Cp>8.1 Workout booking becomes binding at the moment of booking confirmation and Credit deduction (or by accepting an invitation from a Trainer).\u003C/p>\n    \u003Cp>8.2 \u003Cstrong>Cancellation\u003C/strong>:\u003C/p>\n    \u003Cul>\n        \u003Cli>\u003Cstrong>Timely cancellation\u003C/strong> — before the deadline indicated for the workout (\u003Ccode>cancellation_deadline\u003C/code>); Credits are refunded in full.\u003C/li>\n        \u003Cli>\u003Cstrong>Late cancellation\u003C/strong> — after the deadline; a penalty (\u003Ccode>cancellation_penalty\u003C/code>) in Credits is deducted per workout configuration. The penalty may be set up to the full price of the workout.\u003C/li>\n    \u003C/ul>\n    \u003Cp>8.3 \u003Cstrong>No-show\u003C/strong> — if the User is not physically present at the Venue (no QR check-in during the workout window), the workout is automatically marked as \"no-show\" and Credits are not refunded.\u003C/p>\n    \u003Cp>8.4 \u003Cstrong>Cancellation by the Trainer/Venue\u003C/strong> — Credits are refunded to the User automatically in full. The App does not compensate for indirect damages (e.g. travel costs).\u003C/p>\n    \u003Cp>8.5 \u003Cstrong>Watchdog\u003C/strong> — if a workout is full, the User may opt for a notification when a spot opens up. The notification does not guarantee the booking; the User must confirm it themselves.\u003C/p>\n\n    \u003Ch2>9. Venue Entry (QR Check-in)\u003C/h2>\n    \u003Cp>9.1 Venue entry is recorded via a \u003Cstrong>QR code\u003C/strong>. Each User has a unique signed QR code generated by the App.\u003C/p>\n    \u003Cp>9.2 When the QR code is scanned, the App automatically:\u003C/p>\n    \u003Cul>\n        \u003Cli>verifies the User's identity and current Credit balance;\u003C/li>\n        \u003Cli>deducts the entry fee (\u003Ccode>entry_fee_credits\u003C/code>) unless an exemption applies (e.g. free first entry, prior workout booking);\u003C/li>\n        \u003Cli>records a visit (\u003Ccode>venue_visit\u003C/code>).\u003C/li>\n    \u003C/ul>\n    \u003Cp>9.3 \u003Cstrong>Automatic exit\u003C/strong>: If the User does not check out, they are automatically signed out after 2.5 hours. Before automatic exit the User receives a warning notification.\u003C/p>\n    \u003Cp>9.4 The QR code is personal and must not be shared with third parties. Misuse may result in account blocking and liability for damages.\u003C/p>\n\n    \u003Ch2>10. Pricing and Payment Terms\u003C/h2>\n    \u003Cp>10.1 Core App features for the \u003Cem>user\u003C/em> and \u003Cem>trainer\u003C/em> Roles may be provided \u003Cstrong>free of charge\u003C/strong>, unless the Provider states otherwise. The current price list is available in the App.\u003C/p>\n    \u003Cp>10.2 \u003Cstrong>Credit purchase\u003C/strong>: The User may top up the Credit Wallet at a specific Partner or Trainer in the following ways (availability depends on the payee's configuration):\u003C/p>\n    \u003Cul>\n        \u003Cli>\u003Cstrong>by payment card\u003C/strong> via the \u003Cstrong>Stripe\u003C/strong> payment gateway — the payment goes directly to the Partner's/Trainer's account at the gateway and Credits are added automatically;\u003C/li>\n        \u003Cli>\u003Cstrong>by bank transfer\u003C/strong> (QR payment with a variable symbol) directly to the Partner's/Trainer's bank account — Credits are added once the payee confirms receipt;\u003C/li>\n        \u003Cli>\u003Cstrong>in cash\u003C/strong> with the Partner/Trainer — Credits are added manually by the staff.\u003C/li>\n    \u003C/ul>\n    \u003Cp>The Provider neither receives nor holds Users' payments; money always goes directly to the Partner or Trainer. For intermediating card payments the Provider charges a commission borne by the Partner/Trainer; the price towards the User is not affected.\u003C/p>\n    \u003Cp>10.3 \u003Cstrong>Pricing party\u003C/strong>:\u003C/p>\n    \u003Cul>\n        \u003Cli>When purchasing Credits and using services, the contractual relationship is concluded between the User and the Partner or Trainer; the Provider acts as a technical intermediary and maintains the records in the App. Tax documents for the provided services are issued by the Partner/Trainer.\u003C/li>\n        \u003Cli>The tax invoice for the Credit purchase is issued by the Provider or the Partner in compliance with Act No. 235/2004 Coll. on VAT and delivered to the User electronically.\u003C/li>\n    \u003C/ul>\n    \u003Cp>10.4 \u003Cstrong>B2B services for Partners and Trainers\u003C/strong> are subject to a separate price list, available in the \"Partner/Trainer\" section of the App. Invoicing is monthly with 14-day payment terms unless agreed otherwise.\u003C/p>\n    \u003Cp>10.5 \u003Cstrong>All prices are inclusive of VAT\u003C/strong> unless explicitly stated otherwise.\u003C/p>\n    \u003Cp>10.6 In the event of late payment the Provider may charge statutory default interest and, after repeated notice, restrict access to the Service.\u003C/p>\n\n    \u003Ch2>11. Consumer Rights\u003C/h2>\n    \u003Cp>11.1 This section applies only to Users who are \u003Cstrong>consumers\u003C/strong> within the meaning of § 419 of the Czech Civil Code.\u003C/p>\n    \u003Cp>11.2 \u003Cstrong>14-day right of withdrawal\u003C/strong>: The consumer has the right to withdraw from the contract for digital content/service without giving any reason within 14 days of its conclusion.\u003C/p>\n    \u003Cp>11.3 \u003Cstrong>Exception\u003C/strong>: Withdrawal \u003Cstrong>is not possible\u003C/strong> once the service has begun to be provided with the User's express consent (typically Credit usage, completed workout/entry). By starting to use the service, the consumer acknowledges loss of the right of withdrawal.\u003C/p>\n    \u003Cp>11.4 \u003Cstrong>Withdrawal procedure\u003C/strong>: The consumer sends a written notice to the Provider's e-mail (\u003Ca href=\"mailto:info@stelixholding.cz\">info@stelixholding.cz\u003C/a>). A model form is available on request. Refund of the paid amount is made within 14 days of receipt of the withdrawal by the same payment method.\u003C/p>\n    \u003Cp>11.5 \u003Cstrong>Complaints\u003C/strong>: If the Service does not correspond to the description or is defective, the consumer has the right to free remedy. Complaints may be filed by e-mail at \u003Ca href=\"mailto:info@stelixholding.cz\">info@stelixholding.cz\u003C/a>. The Provider undertakes to decide on the complaint within 30 days.\u003C/p>\n    \u003Cp>11.6 \u003Cstrong>Out-of-court dispute resolution\u003C/strong>: The competent body for out-of-court resolution of consumer disputes is the \u003Cstrong>Czech Trade Inspection Authority\u003C/strong> (Štěpánská 567/15, 120 00 Prague 2, \u003Ca href=\"https://www.coi.cz/\" target=\"_blank\" rel=\"noopener\">coi.cz\u003C/a>), to which the consumer may turn.\u003C/p>\n    \u003Cp>11.7 \u003Cstrong>Conformity of digital content\u003C/strong>: The Provider supplies the digital content and digital service in conformity with the contract pursuant to § 2389a et seq. of the Civil Code — in particular in the agreed scope, quality and design, fit for the usual purpose and supplied continuously for the duration of the obligation. If the digital content/service is defective, the consumer has rights from defective performance under § 2389k et seq. of the Civil Code (in particular the right to have the defect remedied, a reasonable discount, or to withdraw from the contract).\u003C/p>\n    \u003Cp>11.8 \u003Cstrong>Updates\u003C/strong>: For the duration of the Service the Provider provides the updates necessary to keep the digital content in conformity with the contract, including security updates, and informs Users of them in the usual manner. If the User fails to install an available update within a reasonable time, the Provider is not liable for defects arising solely from the failure to install it.\u003C/p>\n\n    \u003Ch2>12. Intellectual Property\u003C/h2>\n    \u003Cp>12.1 All rights to the App, its components, design, source code, trademarks (in particular \"fitliftly\") and databases belong to the Provider or its licensors.\u003C/p>\n    \u003Cp>12.2 The User is granted a non-exclusive, non-transferable licence to use the App only to the extent necessary for using the Service. In particular, the User shall not:\u003C/p>\n    \u003Cul>\n        \u003Cli>make copies of the source code or databases;\u003C/li>\n        \u003Cli>perform reverse engineering or decompilation;\u003C/li>\n        \u003Cli>use the App for the development of a competing product;\u003C/li>\n        \u003Cli>remove or modify marks and copyright notices.\u003C/li>\n    \u003C/ul>\n    \u003Cp>12.3 The User remains the owner of the Content uploaded to the App (photos, texts etc.) — see Art. 5.2 regarding the licence granted to the Provider.\u003C/p>\n    \u003Cp>12.4 \u003Cstrong>Lesson names and third-party trademarks\u003C/strong> — Workout and lesson names are entered into the App by the Partner or Trainer as their own content. The Partner and the Trainer declare that they hold the necessary rights or licences to the designations they use in lesson names (in particular designations protected by trademark, such as the names of licensed exercise programmes). The Provider does not use, suggest or pre-approve such designations; lessons in the App are categorised exclusively by the Provider's generic categories.\u003C/p>\n    \u003Cp>12.5 \u003Cstrong>Liability and indemnification\u003C/strong> — The Partner or Trainer who entered a lesson name is liable for any harm caused by infringing third-party rights through its use. They undertake to compensate the Provider for all damage, penalties, costs of proceedings and reasonably incurred legal costs arising in connection with such infringement. Upon receiving a credible notice of infringement, the Provider is entitled to hide or remove the affected name (notice-and-takedown under Regulation (EU) 2022/2065 on digital services); notices may be sent electronically pursuant to Art. 17.4.\u003C/p>\n\n    \u003Ch2>13. Service Availability and Limitation of Liability\u003C/h2>\n    \u003Cp>13.1 The Provider strives to ensure availability of the Service at a level of \u003Cstrong>at least 98% on an annual average\u003C/strong>, excluding scheduled maintenance and force majeure events.\u003C/p>\n    \u003Cp>13.2 Scheduled maintenance is announced to Users in advance (typically outside peak hours).\u003C/p>\n    \u003Cp>13.3 The Provider is not liable for:\u003C/p>\n    \u003Cul>\n        \u003Cli>unavailability caused by internet or device failures on the User's side;\u003C/li>\n        \u003Cli>data loss caused by unauthorised third-party intrusion;\u003C/li>\n        \u003Cli>conduct of Partners, Trainers or other Users (the App is solely a platform);\u003C/li>\n        \u003Cli>damage caused by incorrect interpretation of statistics, recommendations or health data — the App \u003Cstrong>does not provide medical or health advice\u003C/strong>;\u003C/li>\n        \u003Cli>indirect damages, lost profits, loss of reputation.\u003C/li>\n    \u003C/ul>\n    \u003Cp>13.4 The maximum amount of damages the Provider is obliged to pay to the User is limited to the \u003Cstrong>total amount\u003C/strong> paid by the User to the Provider over the previous 12 months. \u003Cstrong>These limitations apply only to the extent permitted by law\u003C/strong> and do not affect the rights of a consumer under the Civil Code, nor the Provider's liability for damage caused intentionally or by gross negligence or for harm to health or life.\u003C/p>\n    \u003Cp>13.5 \u003Cstrong>Force majeure\u003C/strong> — the Provider is not in default if performance is prevented by circumstances beyond its reasonable control (natural disasters, war, pandemic, failure of critical infrastructure providers, cyber attacks).\u003C/p>\n\n    \u003Ch2>14. Termination\u003C/h2>\n    \u003Cp>14.1 \u003Cstrong>Termination by the User\u003C/strong> — the User may cancel their Account at any time in the \"Privacy & Data\" section. Cancellation is irreversible. The Account is deleted or anonymised in accordance with the Privacy Policy.\u003C/p>\n    \u003Cp>14.2 \u003Cstrong>Termination by the Provider\u003C/strong> — the Provider may terminate the contract (block the Account) in case of:\u003C/p>\n    \u003Cul>\n        \u003Cli>material breach of these Terms by the User (in particular Art. 3, 5, 7, 9);\u003C/li>\n        \u003Cli>reasonable suspicion of fraudulent conduct;\u003C/li>\n        \u003Cli>payment delay exceeding 30 days;\u003C/li>\n        \u003Cli>termination of the Service operation (with at least 60 days' prior notice).\u003C/li>\n    \u003C/ul>\n    \u003Cp>14.3 Upon termination, the right to refund unused Credits is extinguished, \u003Cstrong>except where\u003C/strong> the contract is terminated by the Provider without fault on the User's part (in which case a pro-rata refund is granted).\u003C/p>\n    \u003Cp>14.4 Termination does not affect provisions that by their nature survive (in particular limitation of liability, protection of personal data and dispute resolution). The licence to Content under Art. 5.2 expires upon account termination, except for necessary backups and Content already shared with other Users.\u003C/p>\n\n    \u003Ch2>15. Personal Data Protection\u003C/h2>\n    \u003Cp>15.1 Processing of the User's personal data is governed by the \u003Cstrong>Privacy Policy\u003C/strong>, available as a separate document at \u003Ca href=\"/privacy\">fitliftly.com/privacy\u003C/a> (or in the App).\u003C/p>\n    \u003Cp>15.2 The User provides consent to the Privacy Policy during registration and may withdraw it at any time, to the extent consent is required (not for performance of the contract).\u003C/p>\n\n    \u003Ch2>16. Changes to the Terms\u003C/h2>\n    \u003Cp>16.1 The Provider may amend the Terms. Users are notified of changes via e-mail and/or notification in the App at least \u003Cstrong>30 days\u003C/strong> before the change takes effect.\u003C/p>\n    \u003Cp>16.2 If the User does not agree with a change, they have the right to terminate the contract by cancelling their Account before the change takes effect. Continued use of the Service after the effective date is deemed acceptance of the change.\u003C/p>\n    \u003Cp>16.3 Minor technical adjustments and obvious error corrections that do not affect User rights may be made without prior notice.\u003C/p>\n\n    \u003Ch2>17. Final Provisions\u003C/h2>\n    \u003Cp>17.1 \u003Cstrong>Governing law\u003C/strong> — the relationships arising from these Terms are governed by the law of \u003Cstrong>the Czech Republic\u003C/strong>, in particular the Civil Code. The competent courts are the courts of the Czech Republic.\u003C/p>\n    \u003Cp>17.2 \u003Cstrong>Severability\u003C/strong> — should any provision of these Terms be found invalid or unenforceable, the remaining provisions are not affected. The invalid provision shall be replaced by one as close as possible to the original meaning.\u003C/p>\n    \u003Cp>17.3 \u003Cstrong>Language\u003C/strong> — these Terms are primarily in the Czech language. In case of translation, the Czech version prevails.\u003C/p>\n    \u003Cp>17.4 \u003Cstrong>Communication\u003C/strong> — communication between the parties is conducted electronically (e-mail, in-App notifications).
